The North Adams Zoning Board of Appeals will hold a meeting on Monday, August 19, 2019, at 7:00 p.m. in City Council Chambers in City Hall.

MINUTES

August 19, 2019

Members present Chairman Donald Pecor, Jr., Paul DiLego, Jr., Ross Jacobs, Peter Milanesi, and Christopher
Thomas

Members absent Gregory Roach

Others present William Meranti, Building Inspector

Call to order Chairman Pecor called the meeting to order at 7:01 p.m. The secretary called the roll. Chairman
Pecor requested to move the approval of minutes to after roll call.

Approval of minutes Member Jacobs made a motion to approve the minutes. Member DiLego seconded the
motion. All in favor. Motion passes.

Chairman Pecor read the Zoning statement.

New business
• Case No: Z2019-02 Application of Breck R. Woodard for property located at 206 Corinth Street. Side yard variance requested in an R-3 zone to construct new garage; five (5) feet required, two (2) feet being requested.

Chairman Pecor opened the public hearing to Breck Woodard. Mr. Woodard explained that there is a carriage shed that is not big enough to house vehicles. They would like to build a two-car garage but there is not enough square footage. The front of the house has a slope and it would be expensive to move. They would like approval to move over by two feet.

Member Jacobs clarified that this is the typical existing non-conforming structure and stated that he liked the neighbor statement included in the packet. Chairman Pecor clarified with the neighbors that they have no objection to the proposal. The neighbors stated they had none at all.

Chairman Pecor requested other questions or comments. Member Milanesi commented that it is a pretty tall structure. Mr. Woodard explained that the purpose is to also have an art studio over the garage.

Chairman Pecor stated that his only concern would be if the neighbors had any problems. Mr. Woodard explained that it would be a better situation for the neighbors in regard to the roof slant and the snow.

Member Thomas stated that it would be further away than the current structure.

Member Milanesi stated that they had a nice presentation.

Chairman Pecor requested any further questions or comments from the board and the gallery. Mr. and Mrs. Carollo stated that they were in favor.

Discussion of special permit versus variance. Variance is the agreed decision. Member Milanesi made a motion to grant the variance for 5 feet required, 2 feet requested for the garage at 206 Corinth Street as shown and described on the submitted plan. Variances once approved must state findings for the record. Member Jacobs seconded the motion. All in favor. Motion carried.

Member Milanesi stated that for the findings that the variance goes to the applicant Brett Woodard, for property at 206 Corinth Street. The site will be reviewed in six months to verify conditions are being complied with. Any further changes or revisions must go back to the board for approval. The variance will lapse two years from today’s date if it has not been exercised by that date. The variance must be recorded at the Registry of Deeds. The findings that we are supposed to determine are that based on site conditions and topography and that, we call the variances is due, otherwise you would be causing undue hardship, and it would be financial hardship and it doesn’t change the nature of the neighborhood, you are actually improving it.

Chairman Pecor opened the election of officers.

Member Milanesi nominated Don Pecor as Chair. Don Pecor declined the nomination.

Member Milanesi nominated Ross Jacobs as Chair. Chairman Pecor requested any other nominations from the board. No other nominations. Member Jacobs seconded the nomination. All in favor.

Member Milanesi nominated Don Pecor as Vice Chair. Member DiLego seconded the nomination. All in favor.

Adjournment Meeting adjourned 7:11 p.m.
